Hob Learning Terms of Use
Hob Learning provides a personalized subscription service that allows our members to access video content (“Hob Learning Content”) streamed over the Internet to certain Internet-connected devices.
These Terms of Use govern your use of our service. As used in these Terms of Use, "Hob Learning service", "our service" or "the service" means the personalized service provided by Hob Learning for discovering and watching Hob Learning Content, including all features and functionalities, recommendations, the website, user interfaces, and all associated content and software.
1. Membership
Your Hob Learning membership will continue until terminated. To use the Hob Learning service, you must have Internet access and provide us with one or more valid payment methods. Unless you cancel your membership before your billing date, you authorize us to charge the membership fee for the next billing cycle to your Payment Method (see "Cancellation" below).
2. Promotional Offers
From time to time, we may offer special promotional offers, plans, or memberships (“Offers”). Eligibility for Offers is determined by Hob Learning at its discretion, and we reserve the right to revoke any Offer and place an account on hold if eligibility is not met. Offer eligibility requirements and any other limitations will be provided at the time of sign-up or in other communications.
3. Billing and Cancellation
3.1 Billing Cycle
The membership fee for Hob Learning and any other charges you incur in connection with your use of the service (such as taxes and possible transaction fees) will be charged to your Payment MethoÏd on the payment date indicated on the "Account" page. The length of your billing cycle depends on the type of subscription you choose. In some cases, your payment date may change if your Payment Method is not successfully settled, if you change your subscription plan, or if your paid membership began on a day not contained in a given month.
3.2 Payment Methods
You authorize us to charge any Payment Method associated with your account in case the primary Payment Method is declined or unavailable. If a payment is not successfully settled, we may suspend your access to the service until a valid Payment Method is charged. Local taxes may vary depending on the Payment Method used.
3.3 Updating Payment Methods
You can update your Payment Methods on the Account [a]page. Following any update, you authorize us to continue to charge the applicable Payment Method(s).
3.4 Cancellation
You can cancel your Hob Learning membership at any time, and your access will continue through the end of your billing period. Payments are non-refundable, and we do not provide refunds or credits for any partial membership periods or unused Hob Learning content. To cancel, go to the "Account" page and follow the instructions. If you signed up for Hob Learning using a third-party account and wish to cancel, you may need to do so through that third party.[b]
3.5 Changes to Pricing and Plans
We may modify our subscription plans and service pricing periodically. Any price changes or changes to your subscription plans will be communicated at least 30 days before they apply.
4. Hob Learning Service
4.1 Age Requirement
You must be at least 13 years of age to create a Hob Learning account. If you are under 13, a parent or legal guardian must create the account on your behalf and provide verifiable consent for your access. Minors under 18 may only use the service under the supervision of a parent or legal guardian.
4.2 Personal Use Only
The Hob Learning service and any content viewed through the service are for personal and non-commercial use only. You may not share access outside your household. We grant you a limited, non-exclusive, non-transferable right to access the Hob Learning service and view Hob Learning content. You agree not to use the service for public performances.
4.3 Service Updates
The Hob Learning service, including the content library, is regularly updated. We may also test various aspects of our service, such as promotional features and availability of content.
4.4 Service Usage
You agree to use the Hob Learning service, including all features, in accordance with applicable laws, rules, and restrictions. You agree not to alter or manipulate the service in any way.
4.5 Streaming Quality
The display quality of Hob Learning content may vary by device and Internet connection. You are responsible for all Internet access charges. Minimum connection speeds are recommended for various quality levels.
4.6 Software
Hob Learning software may solely be used for authorized streaming and viewing of Hob Learning content on compatible devices. The software may vary by device and medium, and functionalities may differ. You agree to automatically receive updated versions of the Hob Learning software and related third-party software.
5. Passwords and Account Access
The account owner is responsible for maintaining control over the Hob Learning account and preventing unauthorized access. We may terminate or place accounts on hold if unauthorized or fraudulent activity is suspected.
6. Warranties and Limitations of Liability
The Hob Learning service is provided "as is" and without warranty or condition. You waive all special, indirect, and consequential damages against us, except as required by applicable law.
7. Class Action Waiver
Where permitted by law, you and Hob Learning agree that claims may only be brought in your or its individual capacity and not as a plaintiff or class member in any class or representative proceeding.
8. Miscellaneous
8.1 Governing Law
These Terms of Use shall be governed by Texas law and construed in accordance with U.S. law.
8.2 Unsolicited Materials
Hob Learning does not accept unsolicited materials or ideas and is not responsible for similarities in its content to materials sent to Hob Learning.
8.3 Survival
If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
8.4 Changes to Terms of Use and Assignmet
Hob Learning may modify these Terms of Use periodically. We may assign or transfer this agreement, and you agree to cooperate in such an assignment.
8.5 Electronic Communications
We will send you account-related information electronically (e.g., invoices, notices) via email or other electronic methods.
